US Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the judge pointed out that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
